San Antonio Area Designated in Attainment of Eight-Hour Ozone Standard

On April 2, 2008, EPA published a final rule designating thirteen Early Action Compact (“EAC”) Areas, including the San Antonio EAC Area, in attainment of the eight-hour ozone standard.  EPA determined that these attainment designations are appropriate because each EAC area provided quality-assured data from 2005, 2006 and 2007 that demonstrated attainment of the eight-hour ozone standard by December 31, 2007.  Pursuant to EPA’s eight-hour ozone standard implementing regulations, the one-hour ozone standard will no longer apply in these areas one year after the effective date of the designation.  These attainment designations became effective on April 15, 2008.  Accordingly, the one-hour ozone standard will no longer apply in the San Antonio area as of April 15, 2009.
